    So the gubmint can screw up royally and take a truly innocent life, and then that same gubmint determines the extent of its liability? Sounds like gubmint to me.

    a person ran over the lady and a jury will decide his fate.

    The Sun News posted this pic taken by a bystander moments before the accident. IF this is the real moment and the report says it was the passenger side wheel, it is hard to believe. I still cannot understand why "several men lifted the truck to get her out" when they could have just rolled forward or backward. The bystanders reported the officer/driver was actively engaged in the rescue. IMHO, there is nothing that truck can do that a UTV could not do except provide AC to its occupants. MG

    Once upon a time, a citizen couldn't even sue the government. The Tort Claims Act changed that and provided exceptions where the government can be sued for actions of its employees and agents. The TCA also established caps on damages. There are ways around those caps, but it's an uphill battle and the injured party must establish gross negligence to get there.

    We normal citizens cannot drive on the beach, right? It's a safety and environmental issue, right? Seems to me the avoidance of laziness combined with common sense should have prevented this from ever being a possibility.

    Have to admit I was thinking some young cop with eyes on other things but appears I was wrong

    holy smokes...I know the guy that ran over that woman. Duke Brown was the Beach Safety guy when I was a nit-wit lifeguard working the summers in MB back in the early 90's. I was in my 20's then and he had to have to have been mid-40's at that time. Dang.
    At least I'm housebroken.
