    Default Wetlands Permits

    I have reviewed the Army Corps of Engineers website, and understand they are in charge of permits regulated by section 404 of the clean water act and the Rivers and Harbors Act.

    Assuming this is not a navigable waterway which would require looking at the Rivers and Harbors Act, and further assuming that my planned activity falls within some of the exceptions to section 404 of the clean water act, do I have to worry about permits or regulation from any other state or federal agency before I can work in a jurisdictional wetland?

    What do you have planned? b/c permit reqs vary based on the type of work planned and is specific to each wetland situation

    Trying to get a plan together and trying to make sure I account for all regulatory agencies.

    Clean Water act appears to have up to a 50K penalty per day. I would be broke after a few hours at that rate and want to try to stay on the right side of all the rules.

    you better not move a shovel of dirt in a wetland without a land disturbance permit from the county where you are working. If you are an engineer my apologies.

    I am not familiar with a land disturbance permit.

    What county agency would I contact to obtain this permit?

    Who you contact for the land disturbance depends on where your at. If you are in a urban area (Charleston, Greenville) then they may have an established NPDES program and review their own permits applications. If your in a more rural area then it will be through DHEC . Click on the county you live in and this map will tell you who to call about that

    Get in touch with the Charleston district corps of engineers. They have jurisdiction throughout most of the state. They will inform you of any additional permits/ok letters, etc that you must complete. Some of the other small things they MAY make you consider:
    SCDNR/USFWS: Are you harming any shellfish or protected species with the wetland maniuplation. Typically you will submit some type of form with a location map and they will send you an ok letter or don't do it letter

    SCDAH: Are you disturbing an archeological site.
