Another former server here, most don't know this but a couple of fyi's for thought: yes $2.13/hr is the minimum for a server however, if the tips received by the server do not add up to what the server would have made by the standard $7ish minimum wage then the restaurant is required by law to make up the difference. Many server's and patrons for that matter are unaware of that and don't take the employer to task and that law. And here is the catch why: it also requires that servers would need to report all of their tips to prove they didn't meet the minimum.... most dont report cash tips because they generally will make more than minimum wage (if you're at a decent establishment) and don't want to pay taxes of their full earnings.
