    S.C. mother sues after 10-year-old boy dies in drainpipe

    NORTH CHARLESTON, S.C. - The mother of a 10-year-old boy who was sucked into a drainpipe and drowned during a torrential rainstorm sued the city and a state agency claiming negligence.

    Kiante Ramone Johnson died Aug. 27, 2005, was trying to recover an umbrella when he fell into a swollen ditch near his home. Other children watched helplessly and an adult tried to rescue Johnson but could not, according to the suit.

    The suit claims the drainage area had eroded, forming a ravine where water swept along with increasing speed into the uncovered drain. The lawsuit, brought by Jawanda Nicole Simpson, seeks unspecified damages.

    The lawsuit names several defendants including the city of North Charleston and the state Transportation Department.

    The city's attorney, Brady Hair said, "We feel for this family, but this particular drainage ditch is not the city of North Charleston's property. It's a state-owned road and right of way."

    Transportation Department spokesman Stan Shealy said the department would not comment on a pending lawsuit.

    After the incident, the state agency repaired the drain, said Julie Elmore, an assistant to North Charleston Mayor Keith Summey.

    Terrible Trajedy- BUT
    Is the mother not to blame for allowing the boy to recover the umbrella? It was a torrential rainstorm why bother with a 4 dollar umbrella especially if it is in a ravine with water racing thru it?

    Other children watched helplessly??? What were they doing outside in a torrential rainstorm to begin with??


    Why is she suing the taxpayers? Did she ever report the drainage problem to begin with?

    I would never allow my son to go after a damned umbrella in a torrential rainstorm to begin with- I would go get it but not him-- Mothers neglect-she should be jailed.

    I agree Turdman.
    Be proactive about improving public waterfowl habitat in South Carolina. It's not going to happen by itself, and our help is needed. We have the potential to winter thousands of waterfowl on public grounds if we fight for it.

    I agree a terrible tragedy. There is a lot we don't know. Certainly it was a lapse in judgement in the deceased young man's part. He was 10. Perhaps that can be overlooked. I think I was allowed to play unsupervised when I was 10. If the situation had been repeatedly reported to DOT I would be surprised if they don't settle with her. This may be what the press will call "urban justice"?

    UNSUPERVISED in a TORRENTIAL RAINSTORM around a FLOODING ditch??

    Hell if it was raining that hard I would have wanted to go inside and watch Scooby Doo or maybe play with Barbies oops errrr.. GI JOE LOL

    I did learn to swim in a flooded ditch-- ringworms followed

    sad situation, and it's also sad that everyone alwayys jumps to point a finger at someone else and sue them for all they are worth. taxpayers are going to eat this one big time. mothers own negligence by sending the boy after it

    Sad situation, but even at ten years old, while I could go outside and wander on my own, I didn't go out in a big rainstorm. Mom and Dad had a lot more sense than that, and I did also. I also think I had enough sense than to jump in a "river like" ditch chasing a $4 umbrella. I don't know all the facts but from what I read, looks like the mom has some fault in this.

    Where that happened IS NOT a nice part of town. It's rough even by North Charleston standards, just crawling with "hood rats". To paraphrase Candor, the boy made a poor choice, and suffered for it.
