    Default Any surveyors on site?

    I have a few questions on some land I have a purchase contract on. I have a survey that was completed in 1965. I have some easement/access concerns, but there is some wording on the plat that I would like clarification on. If anyone could be of assistance, I would greatly appreciate it.

    JReb brings up a good point, can you post up an inventory of your deer stands and trail cams?

    JWS is local and can probably help you out- property easements can be trouble.
    I had issues with an adjoining property owner and his mis-use of an easement that wound up in court, $27,000 in legal fees later - I won, I guess. Nobody really wins except the lawyers. I have 2 years of court experience in the matter- ask away.

    Lot 5 is my lot. What is in question is what is outlined in red. On GIS that is part of another parcel. It appears to me that .71 acres has been “separated “ out and is marked as 51’ of R/W. I’m figuring from my research that r/w stands for “right of way” which would allow easement to my property. But this plat, which is the only survey of all the properties in the photo, as it’s an old family plat that is being sold off. I’m getting some pushback from the other adjoining landowners, because they are all family and don’t want to see the property sold .

    50' is pretty typical for a utility and access easement- and from the pic it looks like it even has dirt road access- one of the property deeds will have the wording about the easement details. Even after you find it- they may still try to block your use- which likely will require a lawsuit, or bullets and hogs.

    Also don't go off a GIS map, they have been known to be drawn wrong. I see it a lot.

    A real estate attorney or title abstractor may be of more help to you than a surveyor. A surveyor can write whatever he wants on a plat, the deed will tell you who has access on that easement. If you do have access there/there is an easement in place, you’ll likely also need to verify that you have easement for utilities, as well as ingres/egress.

    Yeah, but they will end up spending twice the amount on therapy and anti-depressants from having to deal with GIS Hell...
