Thread: Property lines/ swamps/ navigable water

    I need some advice from you nice gentlemen

    #1 If you have written permission from a landowner that owns land that terminates in to a swamp near a major creek, are you trespassing if you walk past his property line towards the creek>?

    #2 If a adjacent land owner is a dickhead and thinks he owns the entire swamp, how do you respond to him when he is on top of you telling you are trespassing and it is questionable?

    #3 When he tells you he has your tag numbers and called the law and the GW, do you haul ass or stay and duke it out?

    #4 If there is major creek and you have a landowners permission to launch a boat in the creek, are you trespassing if you have to enter the swamp to hunt or pick up dead birds?

    Unless he has evidence of where you were standing- I would not be to concerned for todays mishap-- hes kinda like Gomer Pyle yelling Citizens Arrest Citizens Arrest on Barney Fife for doing that U-Turn

    I would not do it again without understanding the law--he probably has an understanding of the law to have said what he did to you-- you with gun in hand and all--

    Check with whomever gave you written permission to hunt----I would think if it is a small swamp that the property lines would meet in the middle so you would be OK to that point- Unless their was an agreement in the original land deals for him to have it.

    Probably not a good idea to take your gun to pick up birds-- trespassing is better than poaching & trespassing------You need a DOG

    All you need to know is A. Do YOU pay taxes on the property in question? B. Does the fellow who gave you permission pay the taxes on the property in question. If the answer is yes then you are good to go. If the answer is no then keep your ass out. The answer to the questions above are readily found on that counties website under the Assessors Office.

    NUTZ, there is a time and a place...


    Thanks for the replies, swamp is huge 17 different landowners have land terminating in the swamp.....looking for the info now. We have permission to be there, i DO NOT KNOWINGLY trespass, i was taken here by a my nieghbor and he showed me 2 NC written permission slips, signed by the landowners of the to fields we cross to get to the water and the property line is in the water somewhere.
    The question is do we need to have the land surveyed and put up big fucking markers to mark the corners, so we can tell that prick to go to hell? Please Advise.

    If this is a NC situation,any info/advice may be null here.

    Normally ownership extends to the creek run. If that is not the case then THAT states rules on navigable water or unnavigable water would apply.

    If you are on the hoof and cross a property line that you don't have permission to hunt then you are trespassing.

    Like someone above said, get yourself a dog to retrieve your ducks. I have prosecuted many a trespasser but have yet to haul a lab up before the Magistrate...

    it is definately possible for someone to own the swamp from his side all the way to the other side, past a creek and up to the high water mark on the other side.....basically, you can NOT assume that the middle of the creek is the line, this is not always the case. i hunted this morning in the pocataligo swamp with a buddy of mine. the property lines were set way back when and they own from his side all the way across the swamp to the high water mark on the other side. it would be a good thing to check the exact lines, to the middle of the creek is not always a safe bet....

    Is it illegal to have your dog retrieve a bird that fell onto a refuge?

    At ReelFoot a dog is legal to get a bird in refuge but u are not allowed to cross the line period.

    thanks for the replies, guys, got with the man in green today, found out it is 1836 acres of county land, it is the site of a wetlands habitat program, and possibly a future site of watershed hence why it is called a reservoir, totally legal to hunt and our permission is only needed from the land we enter the "reservoir" from. they considered my event "unlawful harrasment" while legally hunting, they told me to that i was ok to hunt there and to be sure to call them monday morning if he bothers us again.

    them mallets is gonna die!
