    I'm assuming because it is evidence of an alleged crime. It must be returned if acquitted. My understanding in this state is that a family member or friend could take possession after the trial if he is convicted assuming family member or friend can pass a background check.

    state law mandates that the guns are tested for their ability to cause harm (paraphrased)

    i forget the charge but it has something to do with brandishing a firearm.
