    Default Governor and boating

    The following general questions relate to the March 30, 2020 Executive Order 2020-16 issued by the Governor of South Carolina and the general responses below are provided as practical guidance by the South Carolina Department of Natural Resources (SCDNR) in consultation with the South Carolina Department of Health and Environmental Control (SCDHEC). The responses below are based on the current situation and are subject to change pursuant to further changes in law, regulations, orders, etc.

    1. What has been closed with the newest executive order?
    Any public beach access and parking areas and other public facilities associated with the access points have been closed. Public piers, docks, wharfs, boat ramps, and boat landings providing public access to the public waters of this State, to include any adjacent or associated public parking lots or other public facilities, shall be closed to public access for recreational purposes for the duration of the State of Emergency. This does not apply to individuals possessing a current, valid commercial fishing license or permit to the extent such individuals seek to utilize or rely upon public piers, docks, wharfs, boat ramps, or boat landings in connection with commercial fishing activities.
    2. How long will this executive order last?
    This order will last until the current State of Emergency ends, or until otherwise rescinded by the Governor.
    3. Does that include the landings within SCDNR Wildlife Management Areas (WMA) and Heritage Preserve (HP) lands? What about State Lakes?
    Yes, this executive order closes landings within all SCDNR WMA and HP lands, as well as on the 18 state lakes. This does not apply to individuals possessing a current, valid commercial fishing license or permit to the extent such individuals seek to utilize or rely upon public piers, docks, wharfs, boat ramps, or boat landings in connection with commercial fishing activities.

    4. Does this order apply to privately-owned ramps?
    No, this order does not close privately-owned ramps or docks.
    5. Is a private neighborhood dock considered public under this order?
    No, this order does not close privately-owned ramps or docks.
    6. Can I just buy a commercial fishing licenses so I can fish?
    The executive order does not prohibit fishing but it does restrict access to public facilities for recreational purposes. The executive order states that all public piers, docks, wharfs, boat ramps, and boat landings providing public access to the public waters of this State, to include any adjacent or associated public parking lots or other public facilities, shall be closed to public access for recreational purposes for the duration of the State of Emergency. Anchoring to fish in a boat is allowed, subject to the provisions of the Governorís previous Executive Orders limiting congregation to groups of three or less. Rafting and beaching are prohibited under all circumstances. In order to meet the exemption to access a public boat facility or pier, an individual must both possess a current, valid commercial fishing license or permit and must seek to utilize or rely upon public piers, docks, wharfs, boat ramps, or boat landings in connection with commercial fishing activities.
    7. I donít have a boat and only go to the landings to bank fish. Is that still okay?
    The executive order does not prohibit fishing but it does restrict access to public facilities for recreational purposes. If it is a public facility, it is closed for recreational purposes. The executive order states that all public piers, docks, wharfs, boat ramps, and boat landings providing public access to the public waters of this State, to include any adjacent or associated public parking lots or other public facilities, shall be closed to public access for recreational purposes for the duration of the State of Emergency. The prohibition does not apply to individuals possessing a current, valid commercial fishing license or permit to the extent such individuals seek to utilize or rely upon public piers, docks, wharfs, boat ramps, or boat landings in connection with commercial fishing activities. The closure does not affect privately owned facilities. The Governorís previous Executive Orders prohibiting congregation in groups of three or more still applies.
    8. I have a boat and I just want to fish. Is that allowed?
    The executive order does not prohibit fishing, but it does restrict access to public facilities for recreational purposes. The executive order states that all public piers, docks, wharfs, boat ramps, and boat landings providing public access to the public waters of this State, to include any adjacent or associated public parking lots or other public facilities, shall be closed to public access for recreational purposes for the duration of the State of Emergency. This does not apply to private facilities. Anchoring to fish in a boat is allowed, subject to the provisions of the Governorís

    previous Executive Orders enforcing social distancing guidelines. Rafting and beaching whether on a sandbar, lakeshore, riverbank, or island is prohibited.
    9. Does this order apply to fishing piers?
    The executive order applies to publicly owned or controlled fishing piers. This does not apply to privately owned facilities. All public piers, docks, wharfs, boat ramps, and boat landings providing public access to the public waters of this State, to include any adjacent or associated public parking lots or other public facilities, shall be closed to public access for recreational purposes for the duration of the State of Emergency.
    10. Does this apply to fishing charters?
    The executive order does not prohibit fishing but it does restrict access to public facilities for recreational purposes. The prohibition does not apply to individuals possessing a current, valid commercial fishing license or permit to the extent such individuals seek to utilize or rely upon public piers, docks, wharfs, boat ramps, or boat landings in connection with commercial fishing activities. The Governorís previous Executive Orders enforcing social distancing guidelines still apply.
    11. Can I put my boat in and stay by the sandbar?
    No. Beaching or rafting of boats, whether on a sandbar, lakeshore, riverbank, or island is prohibited. Vessels must remain underway at all times unless exigent circumstances exist, or unless anchoring to fish. The Governorís previous Executive Orders enforcing social distancing guidelines still apply.

    I went to the website for the boat and they stated that they had voluntarily shut down...

    Based on President Trump's advice we are taking precautionary action.

    The Big "M" Casino will temporarily shut down. We will be back in operation when it's safe to do so.

    DT- someone needs to let our Guvna know many other businesses need access to public ramps other than just commercial fishing.

    His order won't stop me, only a gun will- but others that rely on the ramps for work are not so fearless. Boat mechanics need to water test boats, marine construction needs access to their equipment floating on the water, etc, etc.

    This reminds me of the law that allows drinking in the back of a limo- or having liquor on a boat only if it is live aboard capable- it stomps on the less fortunate and keeps the wealthy happy.

    I'm putting my offshore boat in a marina because of this- it costs the same money as a new F250 truck payment.

    If a frigging boat dealership is considered essential, and it surely is for the owners and employees wallets, how can any other private business be ordered closed? Their owners and employees' wallets don't matter? This cluster is going to be something...

    I'm not sure the constitution is being followed.

    I am sure his ability to enact emergency power is limited to 15 days unless renewed by the legislature. Today is his last day.

    Are the parking lots adjacent to the mountain streams and rivers open do we can fly fish? It’s not like there isn’t plenty of social distancing on a stream... heck, 100’ is way too close.

    it says wma are not closed and I've seen nothing about national or state forest so id say they are fair game. If a a LEO has to walk that far to catch you fishing i'd say you should be able to fight that in a jury trial for being away from people

    I have a house on Moultrie with a privately owned ramp that’s open to the public beside it. Am I allowed to launch my boat? Truck and trailer would be parked on private property.

    The whole thing is horseshit. You can’t go to a boat landing cause people out having a good time MIGHT take some shit home to peepaw and meemaw. Meanwhile peepaw and meemaw are asshole to belly button at Lowe’s and Home Depot buying pansies or Walmart hunting TP cause they’re bored and can’t go to the doctor or K&W for entertainment. I hope every mother fucker in Columbia gets it and we can start fresh.

    You're a sorry excuse for consuming oxygen to wish this on anyone. Go ahead with your broad brush strokes about peepaw and meemaw. My parents haven't left the house for 3+ weeks. We almost lost my dad last year due to COPD and heart failure as he was on oxygen for awhile. If he was to catch this shit he probably wouldn't make it. So fuck you hoping people catch it. My sister and I do their grocery shopping and drop off in the their carport weekly so they're not exposed. The people packed up nut deep partying on the islands on Murray are the problem. I truly hate it for the father and sons who want to go out and catch a mess of fish.
