How long has the dike been broken?
I don't even know of a broken dike. As I said, a buddy of mine and I were discussing the legality behind of it. Then everyone on here got triggered

It's not illegal if you don't get caught...just make sure you can beat DNR to the landing too
If you are referring to property on the santee, two that come to mind are both still in the grace period to have them repaired, and permits have been granted. Its trespassing.
Couple things...
There are certain places in SC where eminent domain stands.
Both branches of the Cooper river come to mind.
I personally believe that folks that own dilapidated fields should be able to re-dike them.
On the topic of DNR managed impoundments:
I’m not going to be the one to try it, but it would be entertaining to see a court case play out, considering that I’m not real certain how you can be prosecuted for “trespassing” on public (state owned) lands.
There is a certain Cat 1 WMA draw that gets snuck literally every hunt.
Mallards and knowing there is only 1 warden and endless ways out, make folks silly.
Be proactive about improving public waterfowl habitat in South Carolina. It's not going to happen by itself, and our help is needed. We have the potential to winter thousands of waterfowl on public grounds if we fight for it.
The way it was explained to me, purely from the legal side (as it seems we agree on the ethical side)...

I agree, but that is not the case on the Cooper and a few other areas with dike breaches over 50 years old.

No, you can't enter under that scenario without trespassing. You're describing avulsion and property lines do NOT move with avulsion. They will move with accretion but dikes do not suffer from accretion.
Time doesn't turn avulsion into accretion so a 50 year old dike break due to avulsion is still due to avulsion and the property line does not move with it.
