    ANN ARBOR, MICH.
    A company behind a proposed natural gas pipeline that could run through parts of Michigan has sued several landowners to gain access to their property for surveys.

    John DeVries, a lawyer for Rover Pipeline LLC, tells The Ann Arbor News (http://bit.ly/1GD0Jya ) that 17 lawsuits have been filed in Washtenaw, Lenawee and Livingston counties. Eleven of the lawsuits were filed in Washtenaw County Trial Court.

    ET Rover says the lawsuits are a reluctant action taken by the company so crews can conduct civil and environmental surveys. Copies of letters to property owners dated March 19 and included in the recent court filings inform owners of the wish to enter the land.

    The pipeline is planned for Lenawee, Washtenaw and Livingston counties and would connect with other pipelines.

    That's part of the eminent domain laws in South Carolina as well...and, I suspect, most states. You never really own land. You just hold it for whatever government entity wants it for a public (roads, sewers, power lines, etc.) purpose.

    They have to follow procedures and pay market value for it. They can't just 'take' it. But in the end they can get what they need. I and my family have been subjected to the 'takings' process five times over the last 35 years. Hurt me every time it happened.

    I will tell you like the old man told me on my second day surveying... "Land is land, give them another acre." This was his respose to a developer building a house on the wrong lot, not our fault.

    When surveying I will knock on a door before we jump a fence and if no one answers then we do our job... have I had the law called on me? yea. Have I been threatened? yes. Has anyone ever pulled a gun on me at work? sure have. BUT a law suit to enter land? fuck that... I just try and act like a reasonable person and say I am trying to make a living.... and your land is not suitable for the hog farm, but next door to you is perfect

    Most of you don't own shit anyways, the bank does. I bet more than half the people reading this post are making car payments... car p[payments are for suckers.

    we are currently dealing with CGT and a gas line they want to put right through the fucking middle of my place.

    The new one in SC will run through our land. They called to ask to survey it and I said, "That is fine as long as it is not Craig Hooks between April 1st and May 1st. He would just pretend to survey while hunting turkeys."

    its true... I have a new 25 acre tract to hunt, cough cough... I mean survey in Spartanburg county next Monday.

    Oh and Farm and timber surveys are at a bargain basement price if you want to schedule them for April 2016

    The eminent domain laws REQUIRE condemnors to obtain permission before entering private property to survey, stake, explore, etc. The permission may be obtained from the property owner. However if the owner denies permission to enter, the condemnor can petition a court to grant permission to enter and survey.

    If you don't want your land condemned, DENY permission to enter and survey. It's about your only hope. Some judges are loathe to hear such petitions, and will instruct the condemnor to work it out using another route or making some other accommodation.

    But the bottom line is, if the condemnor wants the land and follows the prescribed legal procedures.....in most cases it will get (purchase) the land or easement that it wants.

    Well they didn't ask to survey 2th's place. They had a key to the utility companies lock on the gate and came on in! Maybe that qualifies as permission?

    I don't know the situation. Was there a previously-existing utility easement? If so, the utility company (and its agents) has a right to access the easement.

    Unless state law has changed very recently, NOBODY, including surveyors has a right to enter a fee simple tract unless the owner or the court permits it.

    There are existing power line easements, but they have been surveying for a gas line.

    A power line easement doesn't confer rights of entry on any utility other than the power company. This trespass, and it is trespass, could be used against the utility when they attempt to move forward with a condemnation. Depends on the court / judge whether it would ultimately pose a problem to the utility in its attempt to condemn.

    If you asked me what I was doing it would be surveying the power line fuck stick... call the law tooth, if you want them gone. OR if you dont want to be a dick simply tell them to get the fuck out and I bet a dollar they leave.

    I have had trespass problems for years on my property due to a Santee Cooper High line that crosses my land. Everybody thinks its public property and they can ride and access it as they please.

    Even with gates and no Trespass signs, still had problems. I do not bother calling the cops either anymore. When I catch them trespassing its with a loaded and drawn gun anymore. Just got to be a mean SOB. Only way I have found to get it in there heads to not come back on my property. Horse back riders, motorcycle/atv riders, and hunters have all been escorted off the property and told never to come back.

    Worked to hard to have a nice place for me and my family. You have to be willing to protect your place.

    Horesback riders are the worst offenders in my book. They have a "we were just riding through on our Sunday ride. No harm done." response everytime I catch them.
