    Default Jason Dickey Supreme Court Appeal

    Got this in an email. This is NOT my writing. I'm not that smart.

    However, if you're interested in understanding the seriousness of potentially having to defend yourself from killing someone, even in self defense, this is something you need to read...

    Friends,

    The Jason Dickey case had oral arguments before the SC Supreme Court
    on March 2 earlier this month.

    I would suggest you read the Appellant's brief first (Jason Dickey).
    Then, read the respondent's brief (State of SC). And lastly, watch
    the oral arguments video. You will not properly understand all the
    issues if you watch the video first. All of this can be found at the
    following web site.

    I hope you will all realize how important the Jason Dickey case is to
    anyone who may be forced to defend themselves.

    didn't get to watch all of it but sounds like something we should all take notice on. Right or wrong this guy is gettin flak. In my opinion Dickey was in the right.
    It may be lonely at the top, but its a bitch at the bottom...

    so the security guard, shoots a drunk guy who is attacking him with some unknown weapon and he is charged with manslaughter? wtf happened to the castel doc? dose it not apply to your place of work? how about the company he worked for? smells like a fish processing plant.

    I read both sides of this and it seems pretty apparent that the security guard was acting in self defense and had the Castle Doctrine on his side. Reading the arguments was very informative on how the courts decide if self defense can be used as a legal defense. Particularly the nuance about "heat of passion" bringing on the charge of manslaughter instead of self defense. One needs to be very careful after a justified shooting not to say things like "I was terrified out of my mind" or "I was so afraid I couldn't think". The Only thing one should says is "He was going to kill me. I had no choice but to shoot him first."

    I will be very interested in hearing the final verdict.
