    Dang what a headline! It would only have been better is it said, Trojans Over Cocks like I did it in the title.

    Trojans Over Gamecocks at Supreme Court

    Normally disputes between the University of South Carolina Gamecocks and the University of Southern California Trojans are settled on the playing field but a legal fight over a logo claimed by the two schools was settled by the Supreme Court in favor of the west coast school.

    The justices announced Monday they will not intervene in a conflict between the two schools with each claiming the trademark rights to a fancy script "SC" logo that can be affixed to apparel.

    That is exactly what the University of South Carolina wanted to do on clothes identifying the school's baseball team. The design caught the attention of officials at the University of Southern California who felt the logo looked too much like its own and filed a complaint with the federal Trademark Trial and Appeal Board.

    The TTAB agreed with California's USC concluding that South Carolina's USC's use of the logo was likely to cause consumer confusion. A federal appellate court upheld the ruling but rejected the idea that sports fans or others would mistakenly buy an item thinking it showed support for one school when in fact it was for the other 2,400 miles away. Instead, the appellate court panel determined that South Carolina was improperly trying to trademark a logo that was too similar to Southern California's.

    Monday’s decision means that lower court ruling stands and is a victory for the University of Southern California.

    Obviously the founding dates weren't important to the judges.

    The University was founded as South Carolina College on December 19, 1801, by an act of the General Assembly initiated by Governor John Drayton in an effort to promote harmony between the Lowcountry and the Backcountry. The first president was the Baptist minister Reverend Jonathan Maxcy. Maxcy's tenure lasted from 1804 through 1820.

    The University of Southern California was founded in 1880, making it California's oldest private research university. USC was founded by the donations of several figures in early Los Angeles: a Methodist horticulturist, Ozro Childs, an Irish Catholic former-Governor, John Gately Downey, and a German Jewish banker, Isaiah Hellman.

    Founding dates wouldn't matter if the logo has changed since that date. Had the logo remained the same since the founding of the school then the decision probably would have been different.
