It is my understanding that they charge higher because a jury can always find you guilty of a lesser charge but hey can’t up the charge. If they charged you with manslaughter the jury can not find you guilty of murder. In the opposite I believe they can. I am not a lawyer and may just be wrong.
Guilty of murder, but didn't see anything to lead me to believe first degree murder. At least not from what I've been told first degree is. What I've been taught makes first degree is it being premeditated. I saw nothing in the video to indicate that was her intention from the beginning. I don't think it is manslaughter either, because she intentionally shot him. Maybe some of the legal gurus on hear can clarify for us.

In the thread ECU's referring to, I was making the point that people who are looking to be offended will twist your words if you're not careful. I'm pretty sure that's a fact? Jessie Jackson, Al and many others have gotten rich by exploiting this very tactic.
And regarding my above statement, I was referring to recent "protests" here in Charlotte, as well as in Ferguson. In both cases, a black person was shot by the police. Fact. And as a result, people really DID steal TV's and whatever else they could get their hands on as a result of their "outrage". Again, facts, not my emotion or opinion.

I wasn’t offended, but I appreciate your candor. ECU hit the nail on what I was thinking. I get your train of thought, but don’t get sucked into a few trolls on here that use every opportunity to turn a thread into a race issue. Sometimes those that scream “racism” all of the time have an agenda; regardless of their ethnicity. I spent three years in Oklahoma and could rant about a certain demographic that is stereotyped for stealing copper and anything that wasn’t tied down to support their tooth rotting habit. Fortunately, I’ve been blessed to travel around enough to know that socio-economic conditions can have a big effect on all people. Additionally, I also believe that they have the potential to rise above that. Watch for a while and you will see the same pot stirrers.
