    Does anybody know the rules of navigable water when it comes to entering impounded areas with breached dikes? I know several areas where I fish that have old dike structures that are not being kept up. There are several spots that the impounded area can be accesses right off the river. Is it legal to enter or not?

    I've found that "navigable waters" is defined much like the SCOTUS defined pornography: can't define it but you know it when you see it.

    Go ahead and give it a try. Maybe the DNR won't charge you, but you will be shot for trespassing. Win-Win.

    I keep an AK in my boat just for such occasion...hunting or fishing.

    if you can float a boat in it from the public waterways of SC, you can hunt it because it is the public waterways of the state of SC once the property owner fails to maintain their dike system, they still own the land, but the water on top of it became public when their dike breached, the DNR & the land owner will NOT be happy, they'll probably be ignorant of the law here, & write you a ticket and/or shoot you, but the judge have no choice but to side with you, given that you never got out the boat that is, there are some exceptions to this where Kings Grant could jam you up, but generally, yes you can do what you're describing. just because you can, doesn't mean you should though...

    What if the dike system of a WMA is busted, is all that lies within fair game?
